Terms of Service

Introduction

These Terms of Service ("Terms") govern your use of Murmur, a native macOS voice-to-text application ("App"). Murmur is operated by Vishal V. Shekkar, an individual based in India.

By downloading, installing, or using Murmur, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Please read these Terms carefully. They include important limitations on our liability and your rights.

License Grant

Personal, Non-Commercial Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Murmur on compatible Mac computers for your personal, non-commercial purposes only.

Perpetual License

Once you purchase Murmur, your license to use the purchased version is perpetual. You may continue to use the version you purchased indefinitely, even if we discontinue development. However, we may discontinue technical support and updates at any time.

Restrictions

You may not:

• Copy, modify, or create derivative works of the App or its code
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
• Rent, lease, lend, sell, or transfer the App or your license to it
• Use the App for commercial purposes, including but not limited to providing transcription services to others
• Remove or alter any copyright, trademark, or proprietary notices in the App
• Use the App in any way that violates applicable laws or regulations

Distribution Versions

Murmur is available in two versions:

• App Store Version: A sandboxed version distributed through the Apple App Store. This version copies transcriptions to your clipboard; you paste them manually. It follows Apple's standard purchase and refund policies.
• Direct Download Version: A full-featured version available directly from our website. This version includes auto-paste functionality, which requires Accessibility permission. Purchases are processed via Dodo Payments.

A single purchase applies to only one version. You cannot use a purchase from the App Store version to activate the Direct Download version, and vice versa.

Pricing, Trial & Refunds

One-Time Purchase

Murmur is priced at USD $29 (or equivalent in your local currency) as a one-time purchase. There is no subscription fee. Once you purchase Murmur, you own a perpetual license to the purchased version.

Free Trial

Murmur includes a 7-day free trial with full access to all features. No credit card is required for the Direct Download version's trial. The App Store version follows Apple's standard trial and purchase flow. The trial period begins when you first launch the App. After the trial ends, the App will stop functioning unless you purchase a license.

Payment Processing

Direct Download Version: Payments are processed through Dodo Payments, who acts as the merchant of record. Your transaction is subject to Dodo Payments' terms and privacy policy. We do not directly handle your payment information.

App Store Version: Payments are processed through Apple. Your transaction is subject to Apple's standard purchase terms and privacy policy.

Refunds and Refund Policy

Direct Download Version: We offer an unconditional 14-day money-back guarantee. If you're not happy with Murmur for any reason, email murmur@nihil.codes within 14 days of purchase with your receipt or order details, and we'll process a full refund — no questions asked. After 14 days, refunds are no longer available.

App Store Version: Refunds are governed by Apple's App Store refund policy. Contact Apple directly for refund requests.

Tax

You are responsible for any applicable taxes on your purchase. We will add applicable taxes to the price at checkout, depending on your location.

Acceptable Use Policy

You agree not to use Murmur in any way that:

• Violates any applicable law, regulation, or third-party right (including copyright, trademark, or privacy rights)
• Uses the App to create content that is abusive, defamatory, obscene, or otherwise harmful
• Attempts to access, reverse engineer, or modify the App or our systems without authorization
• Uses the App for commercial purposes, including reselling transcription services or offering Murmur as a service to others
• Interferes with or disrupts the functionality of the App or our systems
• Uses the App in violation of Apple's or Dodo Payments' terms and policies
• Circumvents technical protections, licensing restrictions, or trial limitations

We reserve the right to revoke your license if we determine you have violated these acceptable use policies.

Third-Party Services and Disclaimers

AI and Transcription Providers

Murmur optionally integrates with the following third-party services. These integrations are entirely optional and user-configured:

• OpenAI: For cloud-based transcription and text refinement
• OpenAI-Compatible Endpoints: For compatible third-party AI services
• Cloudflare AI Gateway: For Cloudflare-hosted AI models
• Ollama: For local AI models running on your Mac

Your Responsibility

If you choose to use any third-party service with Murmur, you are solely responsible for:

• Providing your own API keys and credentials
• Understanding and agreeing to that service's terms of service and privacy policy
• Managing and securing your API keys
• Any charges or usage limits imposed by that service
• Compliance with that service's acceptable use policies

We Are Not Responsible

We do not:

• Control how third-party services handle, process, or store your data
• Guarantee the availability, accuracy, or quality of any third-party service
• Bear responsibility if a third-party service breaches your data, becomes unavailable, or changes its terms
• Store, access, or process API keys. Keys are stored securely in your Mac's Keychain
• Have any liability for issues arising from your use of third-party services

You must read the privacy policy and terms of service of any third-party provider before using it with Murmur.

Ollama (Local AI)

If you use Ollama for local AI refinement, Ollama runs entirely on your Mac. We have no control over Ollama's operation or your local setup. Refer to Ollama's documentation and terms for support.

Apple Services

Murmur uses Apple's native services, including microphone access and the Accessibility framework. Your use of these services is also subject to Apple's terms and privacy policies. We are not responsible for any issues arising from Apple's services or policy changes.

Intellectual Property Rights

Murmur's Intellectual Property

Murmur, including all code, design, graphics, logos, and documentation, is owned by Vishal V. Shekkar or used under license. All intellectual property rights are reserved. You acquire no ownership rights by purchasing the App.

Open Source Components

Murmur uses open source libraries and components, including WhisperKit and KeyboardShortcuts. These components are used in compliance with their respective open source licenses (Apache 2.0, MIT, and others). You may review the licenses of these components in the App or at the locations specified in the App's documentation.

Your Content

You retain all rights to content you create using Murmur, including transcriptions and audio recordings. By using Murmur, you grant us the right to:

• Store your transcriptions and recordings on your device only (unless you opt into cloud services)
• Use anonymized, aggregated usage data to improve the App
• Process your audio through the transcription model you select

We do not claim ownership of your transcriptions or recordings. All transcriptions and audio files are stored on your Mac and are yours to use, delete, or export.

Feedback

If you provide us with feedback, suggestions, or bug reports about the App, you grant us a royalty-free, worldwide, perpetual license to use this feedback to improve Murmur, without any obligation to compensate you.

Limitation of Liability

Exclusion of Consequential Damages

To the fullest extent permitted by applicable law, in no event shall Vishal V. Shekkar, Murmur, or any affiliates be liable for:

• Indirect, incidental, special, consequential, punitive, or exemplary damages
• Loss of profits, revenue, data, or business opportunities
• Loss of use, privacy breaches, or reputational harm
• Any damages arising from your use of or inability to use the App

This applies even if we have been advised of the possibility of such damages.

Limitation on Direct Damages

Our total liability for any and all claims arising from or related to these Terms or your use of Murmur shall not exceed the amount you paid for the App in the 12 months preceding the claim (or $29 USD, whichever is greater).

No Liability for Third-Party Services

We are not liable for any issues, data loss, breaches, or failures arising from your use of third-party services (OpenAI, Cloudflare, Ollama, etc.) with Murmur, including loss of API credentials, service outages, or changes in terms.

Audio Processing

We are not liable for inaccurate transcriptions, mishearing, or misinterpretation of audio by the transcription model, whether local or cloud-based.

Local Processing Only

When using local transcription models, all audio processing occurs on your Mac. We have no control over how your hardware handles audio data. We are not liable for issues arising from your device, operating system, or hardware.

Disclaimer of Warranties

As-Is Basis

Murmur is provided "as is" and "as available," without warranty of any kind, express or implied.

No Implied Warranties

We disclaim all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of results
• Uninterrupted or error-free operation

Transcription Quality

We do not warrant that transcriptions will be accurate, complete, or suitable for your purpose. Transcription quality depends on audio input, speaker clarity, background noise, language detection, and the transcription model selected. You are responsible for reviewing and verifying transcriptions before relying on them.

Compatibility and Performance

We do not warrant that Murmur will be compatible with all Mac hardware or macOS versions, or that it will perform at a specific speed or quality. The App requires Apple Silicon (M1–M4) and macOS 26 Tahoe or later.

Availability

We do not warrant that the App will be continuously available, that it will function without interruption, or that any defects will be fixed.

Third-Party Services

We disclaim all warranties related to third-party services (OpenAI, Cloudflare, Ollama, Apple services). You rely on these services at your own risk.

Termination and License Revocation

Termination by You

You may terminate your use of Murmur at any time by uninstalling the App. Your license grants you the right to continue using the version you purchased indefinitely, unless we revoke it.

Termination by Us

We may revoke your license and terminate your right to use Murmur if:

• You violate any provision of these Terms
• You use the App for illegal purposes or in violation of third-party rights
• You reverse engineer, decompile, or attempt to modify the App
• You transfer your license or share it with others in violation of these Terms

We will provide reasonable notice of termination, except in cases of severe violations, fraud, or illegal activity.

Effect of Termination

Upon termination, your right to use Murmur ends immediately. We may revoke your license electronically by marking your activation as inactive. You must stop using the App. Sections that survive termination include Intellectual Property, Limitation of Liability, Disclaimer of Warranties, and Governing Law.

Governing Law and Jurisdiction

Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The laws of India apply regardless of your location.

Jurisdiction and Venue

Any legal action, claim, or dispute arising from these Terms or your use of Murmur shall be subject to the exclusive jurisdiction of the courts located in India. You irrevocably consent to the jurisdiction of these courts and waive any objection based on inconvenient forum or similar grounds.

Alternative Dispute Resolution (Optional)

Before pursuing legal action, we encourage you to contact us at murmur@nihil.codes to attempt to resolve the dispute informally.

Waiver of Class Action

You agree that any legal action or claim shall be brought in your individual capacity, and not as a plaintiff or class member in any purported class action. You waive any right to participate in a class action against us.

No Liability in Certain Jurisdictions

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. If you are located in such a jurisdiction, the limitations in these Terms may not fully apply to you, and you may have additional legal rights.

Modifications to These Terms

We may modify these Terms at any time by posting the updated version on our website. Your continued use of Murmur after changes are posted constitutes your acceptance of the modified Terms. We recommend reviewing these Terms periodically. If you do not agree to modifications, you must uninstall the App and stop using it.

For Direct Download purchases, updates to these Terms apply automatically. For App Store purchases, you are also subject to Apple's terms, which may change independently.

Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal, that provision shall be severed, and the remaining provisions shall continue in full force and effect. If a court finds a provision unenforceable, we may modify it to the minimum extent necessary to make it enforceable while preserving its intent.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of Murmur and supersede all prior agreements, understandings, and negotiations, whether written or oral. If you have agreed to other terms with us in the past (such as a privacy policy or terms for beta testing), those terms remain in effect for their specific purposes, but these Terms govern the use and purchase of the App itself.
